DPP MPs Safe to Move to PP

Prominent Political commentator Dr. Augustine Magolowondo says MPs who might join the now ruling People’s Party (PP) cannot be deemed as having crossed the floor.

Dr. Magolowondo told Zodiak Online this is because PP did not contest the 2009 elections and is not represented in parliament hence Section 65 cannot apply to it.

Close to 30 MPs from late president Bingu wa Mutharika’s Democratic Progressive Party have announced that they rally behind the newly sworn in president Joyce Banda.

“This is a very interesting political development because it is a continuation of a government elected in 2009 where we had a president and his vice,” said Dr. Magolowondo.

Dr. Magolowondo said it is unlikely that all people in the DPP will work with government given a background of a sour relationship between Mrs. Banda and the former ruling party.—Zodiak Online

welcome them but if they committed crimes they must be arrested even if they join PP.they have alot to answer to malawians

This is misleading! If the MPs will not be sacked for crossing the floor, it will only be a political move. But constitutionall y, section 65 reads:“The Speaker shall declare vacant the seat of any member of the National Assembly who was, at the time of his or her election, a member of one political party represented in the National Assembly, other than by that member alone but who has voluntarily ceased to be a member of that party or has joined another political party represented in the National Assembly, or has joined any other political party, or association or organisation whose objectives or activities are political in nature.” --according to The Presidential Referal Appeal No. 44 of 2006. This the law until it is overruled by the Supreme Court of Malawi. This entails that moving from DPP to PP will be deemed crossing the floor by virtue of this Supreme Court decision.
