Former President Peter Mutharika’ Personal Bodyguard, Norman Chisale, has pleaded with the supreme court of appeal to give him an access to withdraw K50 million from his frozen accounts to settle legal costs.

However, both Attorney General, Thabo Chakaka Nyirenda and director of public prosecution representative, Pirirani Masanjala, have objected to the claim, arguing that state left some property for Chisale’s survival.

This comes when the state is pushing for the forfeiture of property worth K5.8 billion of Chisale, as the state is questioning how the former presidential bodyguard amassed his assets.

Efforts to beg the court to give him access to K50 million are being pursued after the high court rebuffed his 120-million-kwacha request to be withdrawn from his frozen accounts.

Chisale’s lawyer, Chancy Gondwe, told the Court in Blantyre on Wednesday that it was their prayer that the court would grant his client’ wish.

“We pray for an order varying the preservation order in relation to the incurred and yet to be sorted legal cost payable to Messrs Gondwe and Attorney, amounting to K50 million,” said he.

However, Chakaka Nyirenda is protesting the application.

“Basically, we raised some three issues, two were technical in nature. The application before the single member of court is tantamount to an appeal where the powers of one judge of the supreme are limited in nature,” said Nyirenda.

Justice of appeal, Charles Mkandawire has reserved his ruling to a later date.
