Logistical Challenges Affect Cement-gate Case Proceedings

The High Court in Lilongwe has on Monday failed to proceed to hearing of the cement case which involves former presidential aide, Norman Chisale, former director of state residences, Peter Mukhito and former Malawi Revenue Authority (MRA) deputy commissioner general, Roza Mbilizi.

Defense Lawyer, Kalekeni Kaphale says they received a notice from the court that it may not be able to proceed with the case due to logistical challenges, which he did not specify.

This comes after another adjournment of the matter on 6 March this year.

Kaphale says they were notified by the court on the latest decision adding it is yet to set new dates when the case is expected to proceed.

"We received a message from the court  that they may not be able to sit because of logistical issues. They did not give us the date, we are waiting," Kaphale.

Spokesperson for the Ministry of Justice, Frank Namangale has also confirmed the adjournment, saying he could not outline the logistical issues being mentioned.

"Yes, as you rightly got it, the adjournment was indeed due to logistical issues, which we are unable to outline them," wrote Namangale.

The three are being accused of using former President Peter Mutharika’s Taxpayer Identification Number (TPIN) to import cement without paying duty.

Before the previous adjournment, the court heard evidence from state witness, Wilson Upindi, who is the Malawi Revenue Authority's Deputy Director of ICT Risk and Security who showed the court, conversations between suspect, Shaffee Chunara and some individuals relating to issues of cement.

He also implicated some journalists of having discussion with Chunara to have cover up stories on the cement importation issue.
